Welcome to FIDgate. These Terms of Service ("Terms") govern your access to and use of the FIDgate platform, services, and website (collectively, the "Services") provided by FIDgate ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.
2. Service Overview
FIDgate provides a SaaS platform for financial optimization, data analysis, and modeling for utility-scale solar PV and energy storage projects. Our services are designed to help developers, investors, and project finance teams maximize the value and efficiency of their renewable energy investments.
3. User Requirements
To use our Services, you must:
- Be at least 18 years of age
- If representing an organization, have the authority to bind that organization to these Terms
- Comply with our Privacy Policy and applicable GDPR requirements
- Provide accurate and complete registration information
- Maintain the security of your account credentials
4. License Terms
Subject to your compliance with these Terms, FIDgate grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business purposes.
You may not:
- Resell, redistribute, or sublicense the Services
- Reverse-engineer, decompile, or disassemble any part of the platform
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to any systems or networks
- Interfere with or disrupt the integrity or performance of the Services
5. Payment Terms
FIDgate offers both per-project and annual subscription payment options. Payment may be made via bank transfer or through authorized third-party payment processors.
- All fees are quoted in EUR unless otherwise specified
- Advanced features may incur additional fees
- Late payment may result in service suspension
- Refunds are provided in accordance with our refund policy
6. Use Restrictions
The platform cannot be used for fraudulent, malicious, or unlawful purposes. Any violation of these restrictions may result in immediate account termination and potential legal action.
Prohibited activities include but are not limited to:
- Uploading malicious code or harmful content
- Attempting to breach security measures
- Using the platform to harm third parties
- Violating any applicable laws or regulations
7. Intellectual Property
FIDgate retains all rights, title, and interest in the software, algorithms, and proprietary technology underlying the Services. Users retain ownership of their project data uploaded to the platform.
Any feedback, suggestions, or ideas you provide regarding the Services become FIDgate's property under a worldwide, perpetual, royalty-free license.
8. Disclaimers and Limitations of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FIDgate disclaims responsibility for:
- Accuracy of financial projections or modeling outputs
- Third-party data failures or inaccuracies
- Data loss due to technical issues
- External service interruptions
In no event shall FIDgate's total liability exceed the amounts paid by you in the twelve (12) months preceding the claim.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the applicable laws. Any disputes arising from these Terms shall be resolved through:
- Good faith negotiation between the parties
- Mediation, if negotiation fails
- Litigation in the competent courts, as a last resort
10. Changes to Terms
FIDgate reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the platform. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
